PATH’s problem in MD was not just “a paperwork glitch” as PEAT Guy Clarence Martin claimed.
When the MD PSC filed its order on Sept. 9 throwing out PATH’s application, it gave Allegheny Energy 30 days to figure out how to make a lawful application.
Today was the day. Guess what? Allegheny Energy’s lawyer filed a letter telling the PSC:
At this time, the Company continues to consider its filing options, including whether to re-file an application with the Commission, and intends to inform the Commissio of its decision as soon as possible.

Here is the last sentence of the MD PSC Sept. 9 order:
(3) That the Potomac Edison Company shall notify the Commission within 30 days whether it intends to re-file an appropriate application and, if so, when it intends to submit the application.
Allegheny Energy (Potomac Edison is Allegheny’s MD subsidiary.) did not state whether it intends to refile an application nor did it state when it will refile. The power company did not comply with the MD PSC’s order. Why not? Are they considering a redesign of the PATH line to avoid MD altogether?
One thing is clear. All the claims by power company spokesmen that the MD problem was just a minor glitch were total crap.
