PATH Cases in Chaos
The WV PSC has just ordered a 247 day delay in the WV PATH case. Maryland’s PSC dismissed the PATH case there on Sept. 9, and AEP/Allegheny claim they will re-apply in MD by Dec. 31.
Now we learn that the East Virginia SCC has just gotten a recommendation from their hearing examiner that the PATH case should continue as planned in East Virginia. Here is an article about the hearing examiner’s recommendation in today’s Loudoun Times.
I am not exactly clear about SCC procedure in East Virginia, but the Commissioners will probably still have to issue a formal order with their final decision. They could still overrule the hearing examiner’s opinion.
So now there is total chaos in the three states with the PATH project. In Maryland, AEP/Allegheny may be starting from scratch. In WV, the case is half over, but has been delayed for eight months. In East Virginia, who knows what will happen, but the hearing examiner wants to proceed as planned.
Are you surprised? The chaos in the state cases follows directly from PJM/AEP/Allegheny’s poor planning for the whole project.
