Yesterday, the WV PSC issued its order setting December 17, 18, 19 as the dates for the hearing to take evidence in the Mon Power/Potomac Edison billing case. The hearings start at 9:30 a.m.
The public will not be allowed to participate in the hearing, unless you have requested status as an intervenor in the case and have been accepted into the case by the Commissioners. The deadline for you to file as an intervenor is November 27 at 4:00 p.m.
While the current intervenors, the WV Consumer Advocate and the PSC staff, have filed discovery earlier in the case, the Commission did not set a schedule for filing and responding to discovery in this latest order. That is an indication that the Commission may not allow any further discovery in the case, particularly from new intervenors.
If you have been wanting to file public comment in the case, you need to file your comments by the hearing deadline, if you want them to have any impact on the case. The PSC case number is 13-0830-E-GI.
Even though you cannot participate in the case unless you are an intervenor, you should try to attend at least one of the hearing days if you can. It is very educational to see the cozy atmosphere among power company lawyers in Commission proceedings.
